PERSONAL INJURY

From time to time,  we face the cost of recovery from an accident or injury.   Some injuries are minor inconveniences, but others may cost us lost wages,  long term disability,  and potentially financial disaster.     In those serious matters,  the law imposes a clear rule,   found in Louisiana Civil Code Article 2315,  which provides that the person who caused the injury has to respond for it.

Even back in 1870,  the drafters of the Louisiana Civil Law understood that it would be unfair for someone to face financial disaster due to the careless conduct of another.  This is not to say that a person causing an accident is a criminal,  but that as between a person who is hurt and a person who is at fault,   the person at fault has to pay for damages.

Into this picture early on came enterprising businesses who promised to pay such damages in exchange for regular payments in advance:  INSURANCE.    Naturally,  a big part of the profit on insurance sales depends on how much is paid out for damages.   The case law is full of instances where the insurance company claims certain damages cannot be covered because of policy exclusions.     You see, despite the ads claiming friendship and neighborliness,   insurance is a business,   and the insurance company has a staff of lawyers whose job it is to increase profits by reducing payments.   Eventually,   the industry developed the concept of an "adjuster",  a person who is not a lawyer but has great experience in "settlements".   The adjuster wants to get to the injured person and close a deal for as little money as reasonably possible.

By now you should wonder just who,  in these circumstances,   is on YOUR side.  Good insight.  Most people don't realize until they have a major loss that in negligence cases,  the insurance company has lawyers and adjusters at the ready,  in advance.   One of the first things they will do is seek your trust so that they can move toward a quick,  low cost settlement.

The way to protect yourself is to have a lawyer of your own,  who will examine the claim,  apply the law,  and assure you that any settlement is sufficient to cover your loss.   If necessary,  this may require going to Court.
