The Trustee

The TRUSTEE is a lawyer appointed by the Court and under the general supervision of a United States Trustee's Office. The TRUSTEE has the duty to examine you finances, collect any property or assets that can be used to pay debt, and protect the fairness of your filing.

The TRUSTEE can object to your taking Chapter 7 if your income shows enough money to make some kind of reasonable payments under Chapter 13.  Under the new 2005 Law,  there is a specific presumption that if you make more than the median state income for Louisiana, you must file Chapter 13.  This is tricky because that number changes yearly when it is calculated by the government. But the point is the Trustee's job is to make sure you follow the law,  tell the truth and the rights of the creditors are protected.

You must keep the TRUSTEE informed of your address, and provide any information the TRUSTEE requests.
