1.  Representative Cases

1a - Trial Court work

Hopefully your case may be resolved by a reasonable agreement with the government.  But if not,  Paul Marx has long term experience and knowledge of the court room and what the law calls Due Process.  Paul Marx has handled hundreds of criminal matters over the years in State and Federal Courts and there is no room to provide details on each.  These include homicides, robbery, sex offenses, drug cases and many other types of offenses.  (Fees are paid in full in advance.)

You can be certain that your legal rights will be protected by Paul Marx.   Some of the facts faced by our clients and the outcome of their cases include:

Capital Murder - Drug deal followed by Armed Robbery and homicide by gunshot.  Victim was sitting in car in front of a bar.  Defendant alleged to have fired shot and killed him.  Verdict after trial - NOT GUILTY.  Remains one of the only Acquittals in a Capital Case in Lafayette Parish in the last 20 years.  (Co Counsel was Gerald Block) 

Capital Murder -  Double homicide in which the client was caught confessing on video tape surveillance.  The State charged First Degree Murder in the shooting death of two people.  The case could not be resolved without trial.  A jury convicted the client but spared the client from a Death Sentence based on extensive investigation and testimony at trial.

Possession of Child Pornography  - Federal Jury Trial resulted in conviction.  Defendant got the minimum sentence.

Theft -  Client was a convenience store clerk, charged with theft from store when cash register did not balance.  Actually confessed.  Jury Trial resulted in NOT GUILTY verdict as it was proven that the confession was coerced and there was no proof of theft.  Argued to the jury false confession and developed facts in the case which supported that finding.

Possession with Intent to Distribute Cocaine -  Police searched and found nothing.  Second search turned up a crumb which tested as crack cocaine.  Motion to Suppress was filed.  Defendant agreed to reduced sentence of simple possession and probation with a suspended sentence.

Possession of Cocaine - Defendant on trial for cocaine possession.  State offers as evidence two wallets, one from client and one from co-defendant.  Trial court grants NOT GUILTY verdict because the evidence did not show the client ever possessed the cocaine and didn't prove whose wallet held it.

Federal Drug Distribution - Client accused of Conspiracy to Distribute multiple controlled dangerous substances.  Result was a Plea Bargain and suspended sentence based on the  unique circumstances of the client's case.  First offender status and proof of new direction in client's life convinced court not to impose jail time.

Vehicular Homicide - Group of friends out drinking.  Truck stopped in front of the vehicle and unbelted passenger died due to impact.  Driver tested at intoxicated level.  State was convinced to reduce the charge to injury and probation.  Developed facts in mitigation of penalty.

1b  Appellate Cases

After a case is decided,  the next level of jurisdiction is the Court of Appeal, which has the power to change the decision at Trial in a proceeding called the "Appeal".   Counsel in this phase must review all the proceedings leading to conviction and sentence, and determine whether any legal defects are present which might change the result.

Vehicular Homicide - Appeal of case after Trial conviction.  Court REVERSED conviction, finding that the trial court was wrong to convict because the intoxication did not cause the accident.  Victim's car was stalled in the roadway and witnesses had testified "was going to get hit", meaning other conditions unrelated to intoxication caused the accident.

Expert Witness Funding When Client has No Funds - Court ruled that a person with retained lawyer has right to State Funds for necessary experts in defense of criminal charges.

District Attorney cannot Pick Judge - Louisiana Supreme Court ruled that the District Attorney cannot choose the Judge to try your case, and required random allotment to the different Judges in a district.

State v Kennedy - Death Penalty prohibited in rape of a child cases.  Mr. Marx worked on "Amicus" brief, which is "friend of the court" brief that the Courts consider from interested parties who are not directly involved in the case.

3c - State and Federal Supreme Court Cases

Mr. Marx is admitted to the Federal District Court for the Western District of Louisiana,  the United States Fifth Circuit Court of Appeals, and the United States Supreme Court and has handled cases in each of those courts.  He is familiar with the Sentencing Guidelines and recent developments in Criminal Justice in the Federal Courts.

2.  Work in Lawyer Training

Paul Marx has lectured for 20 years on the latest developments in Criminal Law, including cases covering homicide, robbery, sex offenses and most other crimes.   This means that he makes an annual survey of the recent decisions, and how the court procedures change from year to year as well as new crimes and new sentencing laws that impact your case.

4a - CRIMINAL JUSTICE

Mr. Marx is on one of the most respected and experienced Criminal Trial Lawyers in Louisiana.   He has nearly 30 years experience in Felony Defense,   primarily in State Court but including work in the United States District Courts as well.  One of the special areas Mr. Marx has worked in is Capital Defense, which is a highly specialized arena involving particularly complex legal issues and strategies.  Cases accepted include felonies and serious misdemeanors.   Fees depend on the case.

 For those who can afford to pay an attorney,  the choice can be critical.  Does the lawyer have experience in investigation and criminal law?   Will the lawyer be honest with you about the elements of your case and the issues you face?  Getting the right answers requires that you have a lawyer who is  1) capable of taking your case through trial; 2) knowledgeable regarding the criminal law; and 3) experienced enough to fully advise you of the choices to be made. 

You should be careful about false promises: you need frank, expert advice, and you should not pick a lawyer because you hear what you would like to hear.  Consider that a criminal case is a serious and challenging matter, and you don't want to spend you money just to hear a story: you want the truth and consequences side of things.  A lawyer who will fight for you but not treat you as a fool. You should know, it is unlawful for any attorney to guarantee a particular result.  If somebody gives you a guarantee, particularly in a criminal case, you may not only be facing a criminal charge, but you may be a victim of a crime!

4 b Trial By Jury is complicated.   

If you have a right to a complicated process like a TRIAL,  with rules about who can say what and rules about what can be considered as EVIDENCE,   then you must either know the system or have someone who does on your side.  That's why you have the RIGHT TO COUNSEL,  meaning that the GOVERNMENT can't lock you up without going through DUE PROCESS,  including you having a lawyer.

Sometimes a lawyer knows the client has done wrong.  That doesn't mean that the charges are correct and the lawyer still must fight for the client to the best possible extent.   Certainly I am saddened by some of the tragic cases that come to court,   and sometimes it is difficult to do my job,  but I will always do the very best I can for my client.  Sometimes I am literally the only person who is on my client's side in a case.  With all the money and power,  the government can take care of itself.   I want the government to be put to the test on its claims before someone loses their freedom.
