The Trustee

The Trustee is the attorney appointed by the court to be sure that the rights of the creditors are protected, and that the Debtor's property at the time of the filing is fairly handled. The TRUSTEE also conducts the CREDITORS' MEETING and you are required to attend a class on debt and finance called "Debtor's Orientation", conducted by the Trustee on the date of your Creditors Meeting.

You must provide the Trustee with complete information on your finances,  including recent tax returns and employment payroll records.     If your tax refund is 'Disposible Income',  you will have to pay any tax refund to the Trustee as well.

The Trustee receives your monthly Plan Payment,   and takes care of sending the proper amounts to the Creditors.   This simplifies things for you,  because the Trustee deals with your creditors  and you make one payment through the Trustee's office.

You first meet the Trustee at the 341 Meeting,   which is also called "Creditor's Meeting".  This is a few weeks after filing.  Creditors can appear and ask some simple questions,   and the Trustee will usually point out any problems with the amount you intend to pay under your Plan or particular claims outstanding.
