What is Bankruptcy?
Bankruptcy is a set of Federal Statutes that gives individuals and businesses a chance to re-start their finances. It's called a FRESH START, and that means you can often get out of a bottomless pit of debt and begin to live again.
The details vary, but the role of your lawyer is to make sure you follow the rules so that you can get debts cancelled (called a DISCHARGE) and have future earnings for yourself, not your creditors. You file sworn papers showing what you own, who you owe and what your income is, and following the legal process, the court will clear your debt. Homes are exempt up to an amount provided by State Law, one car worth $7,500 or less, and most household goods, clothing, and personal effects. This means you keep this stuff, and get rid of DEBT.
